  1. INTRODUCTION

    Producers, LLC, its affiliates and partners (collectively, the “Producers Group”, “PG,” “we” or “us”) provide various entertainment websites including this website (“PG Websites”) and related services, such as, applications, community pages and any other features, content, promotions or games offered from time to time by PG including when accessed via the Internet, mobile or other devices (collectively, “PG Services”).

As set forth in PG Terms of Use, PG Services are general audience, are not targeted to children, and do not knowingly collect personal information from minors under 18 years of age. When you submit such information on the Site, you represent that you are at least 18 years of age and that you have the authority to register with the Site. IF YOU ARE UNDER THE AGE OF 18, A PARENT/LEGAL GUARDIAN MUST SUPERVISE YOUR USE OF THE SITE AND REGISTRATION AND BE RESPONSIBLE FOR ALL YOUR CONDUCT ON THE SITE.

This Privacy Policy applies to all users, including both those who use a PG Service without being registered with PG or subscribing to a PG Service and those who have registered with or subscribed to any PG Service. This Privacy Policy describes PG’s collection and use of users’ personal information (e.g., information that identifies a specific person, such as full name or email address) where that information is not otherwise publicly available on PG Services. We also describe generally PG’s practices for handling non-personally identifiable information (e.g., interests, demographics and site usage) to the extent such information is associated with a particular user or user account. Your access to and use of certain PG Services may require you to accept additional terms and conditions or a privacy policy applicable to such PG Services.

This Privacy Policy shall not apply to any unsolicited information you provide to us on or through PG Services (“Unsolicited Submissions“). Please see our Terms of Use for our policies regarding such Unsolicited Submissions. All such Unsolicited Submissions shall be deemed to be non-confidential, and we shall be free to reproduce, use, disclose and distribute such Unsolicited Submissions to others without limitation, attribution, or compensation.

  1. SUBMISSION AND COLLECTION OF INFORMATION ON PG SERVICES

User Submitted Information.

  • Third Party Information and Content. If you access a PG Service through a third-party connection or log-in, your user submitted information may also include your user ID and/or user name associated with that third party service, any information/content you have permitted the third party to share with PG, and any information you have made public in connection with that third party service (collectively, “Third Party Information and Content”). Third Party Information and Content obtained in this manner will be governed by this Privacy Policy, any applicable policy of the third party and the terms and conditions and/or terms of use for PG Service.

 

  • Public Information and Posts. This consist of comments or content that you post to PG Services and the information about you that accompanies those posts or content, such as a username and/or user picture. Public Information and Posts will always be public which means it will be available to everyone and will be displayed in search results both on PG Services and on external search engines.

 

  • Registration Information. Information that users must provide to PG at registration for a PG Service, for example, to receive a newsletter, enter a contest or sweepstakes, play a game or take a survey. Registration Information may include, for example, name, contact information, email address, zip code, birthday and other information you choose to provide us. If you register on a casting site we may request your contact information as well as resume information such as your previous employment or skills. As part of the registration process you may be asked to select a user name and password to be used to access your account and restricted areas of the site.

 

PG Collected Information.

  • Cookies and Similar Technologies. We may also use cookies and other tracking technologies (such as browser cookies, pixels, beacons, and Adobe flash technology), which are comprised of small bits of data that often include an anonymous unique identifier. Websites send this data to your browser when you first request a web page and then store the data on your computer so the website can access information when you make subsequent requests for pages from that site. These technologies may be used to collect and store information about your usage of PG Services, such as pages you have visited, search queries you have run, and advertisements you have seen.   • Third Party Cookies and Similar Technologies. Third parties that support PG Services by serving advertisements or providing services, such as providing users with the ability to comment on content, allowing users to share content or tracking aggregate site usage statistics may also use cookies or similar technologies to collect similar information. We may allow selected third parties to place cookies through our site to provide us with better insights into the use of the site or user demographics or to provide relevant advertising to you. These third parties may collect information about a consumer’s online activities over time and across different websites when he or she uses our website. PG does not control these third party technologies and their use is governed by the privacy policies of these third parties using such technologies.

Please note that by blocking any or all cookies you may not have access to certain features or personalization available through PG Services.

  • Collection of Payment Information by a Third Party. PG uses independent third party service providers to manage sales of PG products or services. If you elect to purchase a product or service in connection with PG Services you will be required to provide our independent third party service provider with your payment information which may include your credit card information, billing address or other payment information, full name, phone number and shipping address (collectively, “Payment Information”) in order to purchase such product or service. You acknowledge and agree that PG does not receive your Payment Information, that this Privacy Policy will not apply to any Payment Information that you provide to any independent third party company on PG Services and that all payment obligations related to such purchase shall be governed solely by the applicable independent third party company’s privacy policy. You further acknowledge and agree that PG will have no liability for or control over such independent third party company’s use or protection of your Payment Information. You should check the privacy policy of the independent third party company‘s website to determine how it will handle any Payment Information it collects from you and/or processes. You acknowledge and agree that in the event that such independent third party company experiences a data breach that compromises or otherwise affects your Payment Information, PG shall in no way be responsible or liable to you for such breach. You should contact the applicable independent third party company regarding any such data breach.

 

  1. NOTICE & CHOICE

Means of Notice and Choice.

This Privacy Policy is the primary means by which PG provides you with notice and choice about its collection and use of your personal information. PG will not use your personal information in a manner different from what is described in this Privacy Policy without your permission.

Privacy Policy Changes.

PG may modify this Privacy Policy as necessary. We post the current effective date of this Privacy Policy above. If we make material changes to this Privacy Policy that expand our rights to use your personal information, we will notify you to seek your consent either through an email or a prominent posting on PG Websites. In the event the last email address you provided to PG is not valid or is not capable of delivering the notice to you, PG’s dispatch of an email containing the notice to that e-mail address shall nonetheless constitute effective notice. Please check back here from time to time to review any changes.

Location of Data.

PG Services are hosted in the United States. If you are a user located outside the United States, you understand and consent to having any personal information you provide transferred to, processed, and stored in the United States and other countries where data protection and other privacy laws may not offer the same level of protection as in your jurisdiction, such as in the European Union. This includes the use of cookies and other tracking technologies as described above. As a result, please read this Privacy Policy with care.

Information Made Public Through Use of PG Services.

Users’ Public Information and Posts are always publicly available to anyone, including other users, search engines, advertisers, third party application developers, and anyone else with access to PG Services. Third Party Information and Content may be publicly available according to the permissions you grant to PG, the applicable policies of the third party and the terms and conditions and/or terms of use for PG Service.

How we may use the information we collect

  • To provide and manage PG Services. We use the information we collect from and about users for our general commercial purposes, such as to provide PG Services and features to you, including to measure and improve those services and features, to personalize your experience by delivering relevant content, advertising and marketing messages, to allow you to comment on content, participate in online games, contests, promotions or rewards programs, to enable you to communicate and share with other users or services, and to provide you with customer support and respond to inquiries. We may use aggregated, anonymous data about use of and activity on PG Services to assist us in this regard and such data is not subject to this Privacy Policy.

 

  • To contact you. PG may periodically send promotional materials (e.g., newsletters) or notifications related to PG Services to the email address you provided to us at registration or subscription to your account. If you want to stop receiving promotional materials from PG, follow the unsubscribe instructions at the bottom of each email. There are certain service notification emails that you may not opt-out of as long as you are registered with or subscribed to PG Services, such as notifications of changes to PG Services or policies.

 

  • To deliver relevant promotion. We may use the information you provide to us, and information we collect about your use of PG Services through cookies and other technologies, to assist us in delivering you promotion when you visit PG Services. We may work with third party networks and advertisers who may help deliver this promotion to you. We do not share your non-public personal information with these third parties, but we may share anonymized or aggregated information with them to improve the relevancy of the promotion you see on PG Services.   • To allow third party service providers to assist us in providing and managing PG Services. PG may make your non-public personal information available to certain third party service providers, such as contractors, agents or sponsors, who help us manage or provide PG Services by, for example: developing or supporting products and features; conducting email marketing on our behalf; processing payments; administering message boards; fulfilling orders; processing data or statistics; or assisting with the administration, judging and prize fulfillment aspects of contests, promotions and sweepstakes. These outside service providers are required to protect non-public personal information entrusted to them and not use it for any other purpose than the specific service they are providing to PG.

 

  • With your permission or at your request. We may disclose your information to complete a transaction you have requested, such as to enroll you in a newsletter subscription, enter you in a sweepstakes or to respond to an inquiry or request for information. We may also disclose your information at your request, for example if you request that we share your audition information with our partners or others.

 

  • To protect the rights of PG and our users. There may be instances when PG may disclose user information without providing notice or choice, including situations where PG has a good faith belief that such disclosure is necessary in order to: (i) protect or defend the legal rights, property, or safety of PG, the PG Affiliated Companies or their employees, agents and contractors (including enforcement of our agreements); (ii) protect the safety and security of users of PG Services or members of the public; (iii) protect against fraud or for risk management purposes; or (iv) comply with the law or legal process.

 

  • To complete a merger or sale of assets. If PG sells all or part of its business or makes a sale or transfer of its assets or is otherwise involved in a merger or transfer of all or a material part of its business, PG may transfer your information to the party or parties involved in the transaction as part of that transaction.

 

  1. SECURITY

    PG uses reasonable administrative, technical, personnel and physical measures to safeguard user information in its possession against loss, theft and unauthorized use, disclosure or modification. Unfortunately, no transmission of data over the Internet can ever be guaranteed to be completely secure. It may be possible for third parties not under our control to intercept or access transmissions or private communications unlawfully. While we strive to protect your personal information, PG cannot ensure or warrant the security of any personal information you transmit to us. Any such transmission is done at your own risk. You also play a role in protecting your information.
  2. USER CONTROL

You may cancel your account by clicking on “delete your account” and may unsubscribe to any PG newsletter or promotional email by clicking the “unsubscribe” link at the bottom of the specific newsletter or e-mail. Remember that even after you cancel your account, copies of some information that is publicly viewable may remain viewable in circumstances where, for example, you have commented on content on PG Services or if another person copied, stored or shared your information. We may also retain backup information related to your account on our servers for some time after cancellation for fraud detection or to comply with applicable law or our internal security policies. Unsubscribing from newsletters or promotional emails from us will not stop us from sending you certain service notification emails as you are registered with or subscribed to PG Services, such as notifications of changes to PG Services or policies.

By visiting the Site or by participating in any of the activities offered on the Site, you agree to be bound by these Terms, which govern your access to and use of the Site.

We may, in our sole discretion, modify these Terms of Use without notice to you. If, at any point, you do not agree to these Terms of Use or any changes or updates thereto, your only remedy is not to use the Site and to cancel any accounts that you may have established to access the Site’s features and offerings (“Account(s)”). Your continued use of the Site after such changes or updates have been posted will constitute your acceptance of such changes or updates. We encourage you to check these Terms of Use often for updates.

You may use material displayed on the Site for non-commercial, personal use only, and may not copy, distribute, modify, transmit, reuse, re-post, or use the content of the Site for public or commercial purposes, including the text, images, audio, and video without our written permission.

You do not have ownership rights to any software or other content made available or accessible on the Site, regardless of how such software and content is used or downloaded. PG does not warrant or represent that your use of software, content, and/or other materials displayed on the Site will not infringe rights of third parties not owned by or affiliated with us.

Any unauthorized use of any elements on the Site, including, without limitation, images, text, videos, logos, trademarks and data, may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.

  1. Software. PG and its suppliers grant you a personal, non-exclusive, non-transferrable, revocable license to use any software and associated content (e.g., text, images, video, graphics, music, sound) made available to you on the Site only for and during the authorized use of the Site and/or the product to which the software and content relate. You may not copy, download, modify or create derivative works, publish, transmit, sell or attempt to sell or transfer, or otherwise use or exploit any software or associated content unless we or our suppliers have expressly allowed you to do so.

    6. Your Submissions and User Conduct. If you submit any communication, ideas, suggestions, materials or other submissions (collectively, “Submissions”) to us through the Site by email or otherwise you are transferring to us all of your rights relating to that Submission without any compensation due to you. Unsolicited Submissions

It is our policy not to accept or consider creative materials, ideas, or suggestions other than those specifically requested. This is to avoid any misunderstandings if your ideas are similar to those we have developed independently. Therefore, we must request that you do not send either PG or post any Submissions that contain original creative materials, such as screenplays, stories, original artwork, technical concepts, know-how or techniques. Any Submissions you do transmit to the Site by electronic mail or otherwise will be treated as non-confidential and non-proprietary and will be deemed transferred in full to us.

By transmitting or posting an unsolicited Submission you agree that (a) you own all the rights to the Submission or have the permission of the owner of all rights to the Submission to transmit or post it to the Site; (b) you are not entitled to any compensation, credit or notice whatsoever with respect to such Submission, (c) you are not in violation of the Prohibited Uses and Security Rules set forth in these Terms, and (d) that you waive any right to make any claim against PG, our parent company(ies), subsidiaries or affiliates relating to our use of such Submission, including, without limitation, infringement of proprietary rights, unfair competition, breach of implied contract or breach of confidentiality. The Site may be used only for lawful purposes by individuals authorized by PG. You are responsible for your own Submissions, including the upload, transmission and posting of information, and are responsible for the consequences of their posting on or through the Site. PG specifically prohibits any use of the Site, and requires all users to agree not to use the Site, for any of the following:

  1. Posting any information which is incomplete, false, inaccurate or not your own;

    b. Impersonating another person;

    c. Constituting or encouraging conduct that would constitute a criminal offense, giving rise to civil liability or otherwise violate any city, state, national or international law or regulation or which fails to comply with accepted Internet protocol including without limitation material that we in our sole discretion considers to be, illegal, obscene, sexually explicit, insulting, vulgar, defamatory, libelous, hateful, abusive, excessively violent, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation;

    d. Posting material that is copyrighted or otherwise owned by a third party unless you are the copyright owner or have the permission of the owner to post it;

    e. Posting material that reveals trade secrets, unless you own them or have the permission of the owner;

    f. Posting material that infringes on any other intellectual property, privacy or publicity right of another;

    h. Attempting to interfere in any way with the Site’s or PG’s networks or network security, or attempting to use the Site’s service to gain unauthorized access to any other computer system.

Security Rules.

Violations of system or network security may result in civil or criminal liability. PG will investigate occurrences and may involve, and cooperate with, law enforcement authorities in prosecuting the user or users who are involved in such violations. You are prohibited from violating or attempting to violate the security of the Site, including, without limitation, the following:

  1. Accessing data not intended for such user or logging into a server or account which user is not authorized to access;

    b. Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;

    c. Attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Site, overloading, “flooding”, “mailbombing” or “crashing”; or sending unsolicited e-mail, including promotions and/or advertising of products or services,

Any display of others registered trademarks herein is done so under fair use policy or within the presentation of factual or historical context.  Any presentation of other’s trademarks herein does not indicate implied endorsement or association. We do not grant any license or other authorization to any user of ours or other’s trademarks, service marks, other copyrightable material or any other intellectual property by including them on the Site. Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Site (or that of a third party that may own the Trademarks displayed on the Site) without written permission.
  3. Partner Site/Linked Site. All e-commerce functionality including without limitation any online store is provided by an independent service provider who is fully responsible for operating such functionality, the content and information posted, and the receipt and processing of your payment information. PG is not responsible for and does not participate in the operation of the e-commerce functionality. All conduct relating to the e-commerce functionality occurs on an independent website linked from this Site and is governed by the Terms of Use and Privacy Policy of the third party service provider which can be found on the online store webpages.

    The Site may provide links to other website(s) for your convenience and enjoyment. Please note that if you access other website(s) through such links you do so at your sole risk. We does not review, endorse, or control any content, advertising, products, services, or other materials on or available through those Site, nor are we responsible for any viruses, Trojan horses, or other items of a potentially destructive nature that they may contain.

    Your correspondence or business dealings with advertisers, partners, or other third parties through any site(s), including payment for and delivery of goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such third parties. PG WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES (EVEN IF SUCH DAMAGES ARE FORESEEABLE OR IF WE HAVE BEEN ADVISED OR HAS CONSTRUCTIVE KNOWLEDGE OF THE POSSIBILITY OF SUCH DAMAGES). SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

    12. PG is Not Responsible for Submissions by Site Users. PG reserves the right to monitor Submissions by those who use the Site, but we are not obliged to do so. We disclaim any responsibility for the Content submitted by users on or through any area of the Site. PG cannot and does not seek to limit the opinions and views of our users. Therefore, such opinions and views should not be taken to represent our views or opinion. We do not represent that the content and features on or offered through the Site are appropriate or available for use in all countries.

    13. Termination. We reserve the right to terminate these Terms, to terminate your account and/or refuse service to you at any time without notice for any reason.

    14. Indemnity. You agree to indemnify, defend and hold PG, and its respective parent, subsidiary and affiliated companies (collectively, the “PG Parties”) harmless from and against any and all claims, liability, losses, costs and expenses (including attorneys’ fees) incurred by any PG Parties in connection with any of your transmissions or postings to the Site, your use of the Site, any action taken by PG or its designees as part of their investigation of a suspected violation of these Terms or as a result of their finding or decision that a violation of these Terms has occurred, or in connection with any breach by you of these Terms. THIS INDEMNITY PROVISION APPLIES TO ALL VIOLATIONS DESCRIBED IN OR CONTEMPLATED BY THESE TERMS. We reserve the right, at their own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defense of such claim.

    15. Copyright Infringement and Regulatory Complaints. We are committed to respecting the intellectual property rights of others and prohibit users from uploading and posting materials that infringes another party’s intellectual property rights. We will cooperate with any law enforcement authorities and comply with any judicial order requesting or directing it to disclose the identity of anyone downloading or posting materials, or otherwise using this Site in violation of applicable laws. If you believe that your proprietary rights, including copyright, have been infringed by any content posted by users of any Site, please notify us. If we receive such notice, we will promptly respond to, remove, or disable access to, the material that is claimed to be infringing or to be the subject of any infringing activity.

    When notifying us of any claim that your material has been copied in a way that constitutes copyright infringement, you must provide the following information:
  • a physical or electronic signature of a person authorized to act on behalf of the copyright owner whose work you claim has been infringed;
  • a description of the copyrighted work you claim has been infringed;
  • a description of where the material that you claim is infringing is located on the Site as well as information reasonably sufficient to permit us to locate the material;
  • your address, telephone number, and, if available, your e-mail address;
  • a statement of your good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, their agent, or the law; and

It is often difficult to determine if your intellectual property rights have been violated or if the Digital Millennium Copyright Act (DMCA) requirements have been met. We may request additional information before we remove any infringing material. If a dispute develops as to the correct owner of the rights in question, we reserve the right to remove or disable access to the allegedly infringing material pending resolution of the matter. We will terminate the accounts of users that we determine are repeat infringers.

Please note that under Section 512(f) of the Copyright Act any person who makes false claims that material or an activity is infringing may be subject to liability for damages.

16. Governing Law; Venue; Jury Trial and Class Action Waiver.  These Terms shall be governed by and construed in accordance with the law in effect in the State of Delware, USA and you hereby irrevocably consent, with respect to any dispute hereunder, to the jurisdiction and venue of the state and federal courts located in the State of Delaware. You irrevocably waive any and all rights to trial by jury or to bring an action as a class to the fullest extent permitted by law.

17. Dispute Resolution. You also agree that, in the event any dispute or claim arises out of or relating to your use of the Site or these Terms that you and PG will attempt in good faith to negotiate a written resolution of the matter directly between the parties. You agree that if the matter remains unresolved for forty-five (45) days after notification (via certified mail or personal delivery) that a dispute exists, all parties shall join in mediation services in Orlando, Florida with a mutually agreed mediator in an attempt to resolve the dispute. Should you file any arbitration claims, or any administrative or legal actions without first having attempted to resolve the matter by mediation, then you agree that you will not be entitled to recover attorneys’ fees, even if you would otherwise be entitled to them.

  1. Consent to Processing in United States. By providing any personal information to the Site, all users, including without limitation users outside the United States, fully understand and unambiguously consent to the collection and processing of such information in the United States.

    If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. These Terms constitute the entire agreement between the parties relating to the matters contained herein and shall not be modified except in writing, signed by us.

    You are solely responsible for compliance with all applicable laws of the jurisdiction from which you are accessing the Site. If any part or portions of these Terms of Use shall be declared invalid, void or unenforceable, the remaining Terms of Use shall remain in full force and effect and shall be interpreted as closely as possible to the manner in which they were written.

    These Terms of Use set forth the entire agreement between you and PG governing your use of the Site and should supersede all prior agreements or negotiations concerning the subject matter of these Terms. You may also be subject to additional terms that are applicable to certain parts of the Site.

    Any claim or cause of action you may have with respect to PG or the Site must be commenced within one (1) year after the claim or cause of action arose.

    The failure of PG to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision.

    You may not assign the Terms or any of your rights or obligations under the Terms without our express written consent.

    The Terms inure to the benefit of PG’s successors, assigns and licensees.

    The section titles in the Terms are for convenience only and have no legal or contractual effect.
